1. AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you and Beauty Hub AI ("Company," "we," "us," or "our") concerning your access to and use of our platform and services.

By accessing or using Beauty Hub AI, you agree to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the platform.

2. OUR SERVICES

Beauty Hub AI provides an AI-powered platform specifically designed for beauty brands, including:

• Campaign creation and management tools (Beauty Studio Pro)
• AI-generated images and videos
• Photo and video editing capabilities
• Content library and organization
• Market intelligence and analytics (planned)
• Other features as described on our platform

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice.

3. ACCOUNT REGISTRATION

To use certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 18 years old to use our services. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. SUBSCRIPTIONS & BILLING

4.1 Subscription Plans

We offer various subscription tiers:

• Free Trial: Limited credits to test the platform
• Founding Brands: $39/month with lifetime pricing guarantee (first 100 brands only)
• Basic: $79/month with 150 credits
• Pro: $199/month with 500 credits
• Enterprise: Custom pricing and features

4.2 Billing and Payments

• Subscriptions are billed monthly in advance
• Payments are processed securely through Stripe
• All fees are in USD unless otherwise stated
• You authorize us to charge your payment method on a recurring basis
• Failed payments may result in service suspension

4.3 Credits

Credits are used to generate AI content (1 credit = 1 generation). Credits do not roll over month-to-month and are non-refundable. Unused credits expire at the end of each billing period.

4.4 Founding Brands Lifetime Pricing

Founding Brands members receive lifetime pricing at $39/month, guaranteed as long as their subscription remains active. If a Founding member cancels and later rejoins, they will lose their Founding benefits and lifetime pricing, and must subscribe at current standard rates.

4.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

4.6 Refunds

All subscriptions and purchases are non-refundable. We do not offer refunds for any reason, including partial months, unused credits, or subscription cancellations. All content you create remains yours regardless of subscription status.

4.7 Price Changes

We reserve the right to change our pricing at any time. Founding Brands members are exempt from price increases. For other subscribers, we will provide 30 days' notice of price changes.

5. INTELLECTUAL PROPERTY

5.1 Your Content

You retain full ownership and commercial rights to all content you create, upload, or generate using our platform. You grant us a limited license to use, store, and process your content solely to provide our services to you.

5.2 Our Platform

The Beauty Hub AI platform, including all code, design, features, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our platform.

5.3 AI Training

We do NOT use your content to train AI models without your explicit opt-in consent. You may choose to opt-in to contribute your content to model training in exchange for benefits, but this is entirely voluntary.

6. ACCEPTABLE USE POLICY

You agree NOT to use our platform to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Harass, abuse, or harm others
• Create harmful, offensive, or illegal content
• Attempt to bypass security measures
• Scrape or harvest data from our platform
• Resell or redistribute our services without authorization
• Create deepfakes or misleading content without disclosure
• Impersonate others or misrepresent your identity

Violation of this policy may result in immediate termination of your account and legal action.

7. VOTING RIGHTS (FOUNDING BRANDS)

Founding Brands members receive voting rights on feature development:

• Each member gets one vote per feature proposal
• Features that reach 60% of member votes are prioritized for development
• We commit to building approved features within 4-6 weeks
• Voting rights are non-transferable
• We reserve final discretion on feature implementation details

Voting rights are available only while your Founding membership remains active.

8. DISCLAIMERS & WARRANTIES

OUR PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• Our services will be uninterrupted, secure, or error-free
• AI-generated content will meet your expectations
• All features will be available at all times
• Our services will be compatible with all devices

You use our platform at your own risk. We are not responsible for content generated by AI or how you choose to use it.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, BEAUTY HUB AI SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from your use or inability to use our services
• Damages from AI-generated content or third-party actions

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Beauty Hub AI from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of our services, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) content you create or upload.

11. TERMINATION

We may terminate or suspend your account and access to our services at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Any reason at our sole discretion

Upon termination, your right to use our services ceases immediately. You may download your content within 30 days of termination, after which it may be deleted.

12. DISPUTE RESOLUTION

Any disputes arising from these Terms shall be resolved through:

1. Informal negotiation for 30 days
2. Binding arbitration if negotiation fails
3. Arbitration conducted under AAA rules

You waive the right to participate in class action lawsuits or class-wide arbitration.

13. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. CHANGES TO TERMS

We may modify these Terms at any time. We will notify you of material changes via email or platform notice. Your continued use of our services after changes constitutes acceptance of the new Terms.
